Treofan Germany files for insolvency

Self-administration gives German BOPP film producer time to recover from heavy losses under court supervision.

treofan BPP filmsTreofan Germany, the German subsidiary of the Indian Jindal group specializing in the production of BOPP films, has filed for insolvency proceedings in self-administration.

Through this process, the company intends to carry out a restructuring plan supported by two experienced industry specialists, Lucas F. Flöther and Anna Katharina Wilke of the law firm Flöther & Wissing. The application was accepted by the Local Court of Saarbrücken/Sulzbach, which has jurisdiction over the matter.

Treofan Germany employs about 500 people at its Neunkirchen site in Germany. The company’s financial difficulties stem from a drop in demand, particularly in the packaging sector, which has led to significant losses since fiscal year 2023-24.

The self-administration procedure, provided for under German restructuring law, allows companies to tackle financial difficulties while maintaining business operations in close coordination with creditors. The creditors’ interests are represented by a court-appointed trustee (Sachwalter), who acts as a supervisor in a role similar to that of a supervisory board. The court has appointed Sebastian Mohrs of Abel & Kollegen, assisted by attorney Lukas Eisenhuth, to these functions.

The procedure provides access to extraordinary instruments, such as the ability to terminate or renegotiate unfavorable contracts and temporary relief from personnel costs for up to three months.

“The procedure now gives us financial breathing space and planning security for all parties involved until the end of October. We intend to use this time to carefully reassess the options for a long-term restructuring solution,” emphasized Lucas F. Flöther.
“It is essential to ensure transparency and, within the framework of a structured investor process, to find the best possible solution for the company and its creditors,” added trustee Sebastian Mohrs.

Treofan was acquired in 2018 by Jindal, along with its three BOPP film plants—two in Italy and one in Germany. In the following years, the Indian group divested the Battipaglia site (sold to Jcoplastic) and the Terni plant (sold to Visopack), retaining only the German plant.
